GENERAL CONDITIONS OF SALE
The products on sale on the website www.sartoriavico.it (hereinafter the “Site”) are sold and invoiced by Dissociate Snc di Cristina Del Buono and Stefania Casacci with registered office in via A.M. Ampere no. 55, 20131 Milan, registered in the Milan Company Register under no. rea MI-402147, tax code and p. VAT no. 05610690967 (hereinafter “Sartoria Vico”).

1. Acceptance of the general conditions of sale and conclusion of the contract
The contract stipulated between Sartoria Vico and the customer (i.e. the individual, natural person, who makes the purchase on the site, not relating to his commercial, entrepreneurial or professional activity) must be considered concluded with the acceptance, even if only partial, of the order by Sartoria Vico. In the event of non-acceptance of the order, Sartoria Vico will in any case promptly notify the customer.
By placing an order in the various ways provided, according to the order form on the site (hereinafter the "Order"), the customer declares to have read all the information provided to him during the purchase procedure and to fully accept these general conditions (hereinafter the "Conditions").
It is understood that the Conditions apply to all transactions concluded between Sartoria Vico and the customer without the need for there to be an express reference to them or a specific agreement to this effect at the conclusion of each individual transaction. Any different conditions or terms apply only if confirmed in writing by Sartoria Vico.
These Conditions may be printed or saved on a durable medium, in compliance with the provisions of the art. 12 of Legislative Decree 70/2003 and art. 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.
Sartoria Vico will reimburse the customer for the entire amount paid, net of shipping costs incurred and any customs duties paid for importation, within 14 (fourteen) days from the cancellation date, transferring the charged amount, with the same payment method used by the customer for the initial transaction, unless otherwise agreed. In any case, the customer will not have to bear any expenses incurred as a result of said reimbursement. Sartoria Vico can withhold the refund until the returned product is received.
2. Purchase method
The products offered for sale by Sartoria Vico are only those present on the Sartoria Vico website at the time the Order is placed, as described in the relevant information sheets.
In any case, it is understood that the images accompanying the description of a product are for informational purposes only and may not be perfectly representative of its characteristics but may differ, for example. by color and size (also based on the browser and monitor used to access the site and view the images).
To place an order, the customer must complete the Order in its entirety and send it after having carefully examined the conditions, as well as the characteristics of the product and/or products he intends to purchase. The customer must also request Sartoria Vico, if desired, to issue a tax invoice relating to the purchase, pursuant to art. 22 Presidential Decree No. 633/1972.2.4. The correct receipt of the Order is confirmed by Sartoria Vico by means of a response via e-mail, sent to the e-mail address communicated by the customer. This confirmation message will summarize the purchase conditions, as required by the applicable legislation, as well as the data entered in the Order by the customer, so that the customer can verify the same and possibly communicate the necessary corrections of incorrect data without delay.
3. Prices and payment methods
The prices indicated on the site are to be considered inclusive of taxes and VAT. Any shipping costs or payment costs are in any case communicated in advance to the customer through the site or these conditions.
The following payment methods are available: a) Paypal: the customer can use the Paypal circuit for payment according to its specific methods. b) Credit card: in cases of purchase of goods with credit card payment method, the transaction can take place through the secure Paypal server or another secure server chosen by Sartoria Vico.
It is understood that under no circumstances and at no stage of the payment will Sartoria Vico be able to know the information relating to the Customer's credit card, transmitted via a protected connection directly to the website of the banking institution that manages the transaction. No Sartoria Vico computer archive will retain such data and therefore in no case can Sartoria Vico be held responsible for any fraudulent or improper use of credit cards by third parties at the time of payment.
4. Delivery of products and related costs
The purchased products will be delivered to the address indicated by the customer in the Order within 48 - 72 hours of acceptance of the Order by Sartoria Vico, at the cost specifically indicated on the site before sending the Order. Sartoria Vico reserves the right to accept or not accept deliveries requested outside Italian or European borders. In any case, for deliveries to be carried out outside Italian borders, shipping costs and delivery times may vary.
With regards to deliveries requested in countries not belonging to the European Union, any import customs costs will be borne by the recipient. The Customer is therefore invited to contact the customs authorities of their country in advance to verify the costs and any import limits.
The delivery times indicated by Sartoria Vico must be considered purely indicative and a delay compared to them, or any delivery made with subsequent split shipments, does not entitle the Customer to refuse the delivery itself and to request compensation or compensation.
Upon delivery of the products, the Customer is required to check:
that the number of packages delivered corresponds to what is indicated in the transport document.
that the packaging is intact, not damaged, wet or otherwise altered, even in the closing materials (adhesive tape or metal straps).
Any damage to the packaging and/or to the product or the mismatch in the number of packages or indications must be immediately detected by placing a specific indication on the delivery document of the product to be returned to the courier.
Any problems relating to the physical integrity, correspondence or completeness of the products received must be reported within 7 (seven) days of delivery, according to the methods set out in this document.
5. Cancellation of the Order
Sartoria Vico reserves the right to cancel any Order for the purchase of products, at its discretion, regardless of whether or not the customer's credit card has been charged, in the event that: (a) a material error regarding the price or products of Sartoria Vico had occurred at the time of publication on the Site, or in the event that the product requested by the customer through the Order was no longer available.
If the Order is canceled after payment has been duly made and received, also pursuant to the methods set out in Article 3 above, Sartoria Vico will adopt the necessary measures to re-credit the customer with the same amount as the amount already paid (or may contact the customer to receive information for this purpose).
6. Right of withdrawal
Pursuant to Art. 52 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the customer may withdraw from the Conditions and therefore from the purchase contract for any reason, without the need to provide reasons and without any penalty, within 14 (fourteen) working days from the date of receipt of the products.
To exercise the right of withdrawal referred to in the previous Article 6, the customer must send Sartoria Vico a communication to this effect, within the deadlines indicated, to the address: ecommerce@sartoriavico.it
In case of withdrawal, the customer must send the products back to Sartoria Vico at his own expense within 14 (fourteen) days of the withdrawal itself, according to the following methods:
for parcels coming from European Union countries the shipping address is the following: Sartoria Vico Via A.M. Ampère 55, 20131 Milan, Italy.
for parcels coming from non-European countries, therefore subject to customs, the shipping address is the following: Sartoria Vico Via A.M. Ampère 55, 20131 Milan, Italy.
The goods must be returned intact, complete with all their parts and in the original packaging (envelopes and packages), kept and possibly used for the time strictly necessary to establish and verify their nature, characteristics and size, according to normal diligence, without there being any signs of wear or dirt, in compliance with the conditions set out below:
the right of withdrawal may apply to the product purchased in its entirety; in fact, it will not be possible to exercise the right of withdrawal only on a part of the product purchased (e.g.: accessories, complements, etc.);
for the exercise of the right of withdrawal to be possible and effective, the product must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: labels, tags, tags, seals, etc.);
the authenticity tag must remain attached and the security cord must be intact;
shipping costs (and any customs costs, if any) for returning the goods will be the sole responsibility of the customer;
the shipment, until receipt is certified in the warehouse indicated by Sartoria Vico, will be under the complete responsibility of the customer;
in the event of damage to the goods during transport, Sartoria Vico will notify the customer, to allow him to promptly file a complaint against the courier he has chosen and obtain the relevant refund and the product will then be made available to the customer, simultaneously canceling the withdrawal request;
Sartoria Vico will not be liable in any way for damage, theft or loss occurring during or in any case in connection with the return shipment.
Sartoria Vico will refund the customer the entire amount already paid, net of any additional shipping costs pursuant to art. 56, paragraph 2, of the Legislative Decree. 21/14), within 14 (fourteen) days of withdrawal, through a cancellation procedure of the debited amount, using the same payment method used by the customer for the initial transaction, unless otherwise agreed. In any case, the customer will not bear any costs as a consequence of said reimbursement. Sartoria Vico may suspend the refund until receipt of the returned product or until the customer demonstrates that he has correctly sent the product back, whichever is earlier.
In any case, the customer will lose the right of withdrawal in cases where Sartoria Vico ascertains that:
the returned product and/or its accessories, and/or its packaging are not intact;
the product is missing its external packaging and/or the original internal packaging;
the product is missing integral elements and/or accessories (e.g. closures, laces, buckles, etc.);
In the event that the customer forfeits the right of withdrawal, Sartoria Vico will return the purchased product to the sender, charging the relevant shipping costs and, if already refunded, the price of the product.
7. Guarantees
All products sold by Sartoria Vico are covered by a 24 (twenty-four) month warranty for defects of conformity, pursuant to Title III of the Legislative Decree. 206/2005. To benefit from warranty assistance, the customer must keep the invoice, or the payment receipt, together with the transport document.
The warranty for defects of conformity will apply provided that the relevant product has been used correctly, in compliance with its intended use and as provided in the use and washing instructions present in and/or with the product.
In the event that, for any reason, Sartoria Vico is unable to return a product under warranty to the customer (restored or replaced), or if the repair or replacement is excessively expensive, also due to the value of the product, Sartoria Vico may proceed with an appropriate reduction in the price paid, or rather with the refund of the entire amount paid with termination of the contract.
In cases where the application of the guarantees requires the return of the product, the same must be returned by the customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment).
8. Retention of Title.
The products sold by Sartoria Vico and purchased by the customer remain the full and exclusive property of Sartoria Vico until the date on which the customer has paid the full price of the same and all sums due to Sartoria Vico. Until that moment, the customer retains the products as trustee of Sartoria Vico and must keep the purchased products adequately stored, protected and insured.
In the event that in the country in which the customer has his domicile for the validity of the retention of title in favor of Sartoria Vico it is necessary to complete administrative or legal formalities such as, without any limitation, the registration of the products in public registers, or the affixing of specific seals to them, the customer undertakes from now on to collaborate with Sartoria Vico and to carry out all the necessary actions in order to ensure that the latter obtains a valid right with reference to the retention of title.
9. Sartoria Vico Intellectual Property
The customer expressly acknowledges that the trademarks, trade names, or other distinctive signs affixed to the merchandise are the exclusive property of Sartoria Vico and may not be altered, modified, removed, or erased in any way. The customer has the limited right to use the trademarks, trade names, or other distinctive signs, as well as any other industrial property rights or manufacturing and commercial know-how incorporated into the merchandise, which remain the exclusive property of Sartoria Vico, for the sole and limited purpose of reselling the merchandise to the public. Any other use of Sartoria Vico's intellectual property by the customer, unless expressly granted and authorized by Sartoria Vico in writing, will be considered a violation of Sartoria Vico's aforementioned exclusive rights, including under contractual liability, and will be prosecuted accordingly.
Any documents, drawings, data, and information (whether in paper or electronic format) delivered to the Customer remain the exclusive property of Sartoria Vico and serve as a means of better representing the Products and are indicative of their performance. The Customer undertakes not to reproduce them or disclose them to third parties, and to take appropriate precautions with its personnel to ensure their protection.
10. Limitation of Liability.
Except in cases of justified disputes raised in accordance with the provisions of Article 5 above, the Customer is not entitled to any further rights or remedies. Specifically, Sartoria Vico is not liable for any compensation claimed for breach or non-fulfilment of the contract, for any direct damages or lost profits incurred by the Customer as a result of the use, non-use, or installation of the Products in other products, except in cases covered by the warranty pursuant to Article 6 above or in cases of willful misconduct or gross negligence on the part of Sartoria Vico.
Sartoria Vico will use its best efforts to deliver the products within any agreed upon timeframes, but under no circumstances will it be held liable for damages directly or indirectly caused by the delayed performance of a contract or the delayed delivery of the Products.
Sartoria Vico's catalogs, price lists, or other promotional materials merely provide an indication of the type of products and prices, and the information contained therein is not binding on Sartoria Vico. Sartoria Vico assumes no responsibility for errors or omissions in its price lists or promotional materials.

12. Privacy
Personal data collected when an Order is placed will be processed by Sartoria Vico solely to fulfill the customer's express requests, in compliance with EU Regulation 2016/679 and the privacy policy on the website. Any further processing will be carried out only with the customer's express consent.
13. Applicable Law and Jurisdiction
The sales contract referred to in these conditions and its performance are governed by Italian law, without regard to conflict of laws rules and the United Nations Convention on Contracts for the International Sale of Goods. Any disputes arising from or relating to this contract shall be subject to the jurisdiction of the court of the consumer's place of residence or domicile, where located in Italy.
14. Final Provisions
The invalidity, in whole or in part, of any provision of these Terms and Conditions does not affect the validity of the remaining provisions.
Pursuant to Articles 1341 and 1342 of the Italian Civil Code, the customer specifically approves the following provisions: Article 1 – Applicability of the Terms and Conditions to all contracts; Article 2 – Purchase Methods; Article 3 – Prices and Payment Methods; Article 4 – Delivery of Products and Related Charges; Article 5 – Cancellation of the Order; Article 8 – Retention of Title; Article 9 – Sartoria Vico Intellectual Property; Article 10 – Limitation of Liability; Article 13 – Applicable Law and Jurisdiction.
